Residency.Resident Tuition Assessment A. For the purpose of tuition assessment under this chapter, a resident is a person who, at the time of class registrationend of the add/drop period for regular semester-length courses, is a United States citizen or eligible non-citizen that has been physically present in ֱƵ for two years, except for documented absences due to illness, vacations, or attendance at another educational institution while maintaining ֱƵ residency, or other absence for periods not exceeding an aggregate of 120 days, and who declares the intention to remain in ֱƵ indefinitely. Eligible non-citizen shall have the same meaning as that term is used in determining eligibility for federal student financial aid. Physical presence will be determined by criteria established in university regulation. Alternatively, a person who received or has been qualified by the State of ֱƵ Permanent Fund Dividend Division to receive an ֱƵ Permanent Fund Dividend within the last twelve months, certifies they have been in ֱƵ for the past twelve months, and declares their intent to remain in ֱƵ indefinitely or meets other resident tuition eligibility requirements specified in regents policy will be eligible for resident tuition assessment. The MAU chief enrollment officer or designee will apply these rules to the facts in individual cases. A person who has been physically present in ֱƵ for one year, except for the same excused absences as delineated above, and proves bona fide residency is also a "resident" for purposes of tuition assessment. However, any person who, within two years of class registration, has declared residency in another state, voted in another state, or done any act inconsistent with ֱƵ residence will be deemed a nonresident for purposes of tuition assessment, unless otherwise exempted by this policy or university regulation. A dependent child of a resident is a resident for purposes of tuition assessment. B. Notwithstanding the provisions of subsection A above, this section, a student will be ineligible for resident tuition purposes unless exempted by P05.10.050 if: the residency of a student who first registered at the university prior to the effective date of the adoption of this policy shall be determined under the regents policy in effect at the time the student registered. 1. during the two years of claimed residency, the student was absent from ֱƵ for an aggregate of more than 120 days other than documented absences due to illness, or attendance at another educational institution while maintaining ֱƵ residency; 2. during the prior two years, the student did any act inconsistent with ֱƵ residency such as claiming residency in another state or voting as a resident of another state; 3. during the past two years, the student has registered as a resident in an educational institution in another state; or 4. during the past two years, the student has paid tuition at the University of ֱƵ at the Western Undergraduate Exchange (WUE) program rate. (xx-xx-xx) P05.10.050. Nonresident Tuition Surcharge. Any person who does not qualify as an ֱƵ resident under this chapterP05.10.025, or has not otherwise been exempted under this chapter or implementing university regulation, will be assessed a nonresident tuition surcharge in addition to regular tuition. However, tThe following persons or groups are exempted from nonresident tuition surcharges and treated as a resident for the purpose of tuition assessment: A. Military personnel on active duty in ֱƵ, their spouses and Dependent dependent Childrenchildren, regardless of their state residency status; B. Members of the ֱƵ National Guard, their spouses and dependent children, regardless of whether they yet qualify as residents of the state under any other requirements; C. Dependent children of a person who graduated and holds an Associate, Bachelors, Masters or Doctors degree from the University of ֱƵ; D. Dependent children of an ֱƵ resident as evidenced by the most current federal income tax return filed within the past 16 months; DE. Students participating in the Western Interstate Commission on Higher Education (WICHE) Western Regional Graduate Program (WRGP); E.F Students enrolled for four or fewer credit hours within the UA system during a semester; G. Students from other states or provinces whose public universities waive nonresident tuition surcharges for ֱƵ residents, as may be approved by the university president; a list of participating states or universities shall be published in university regulation; H. Students from foreign cities and provinces that establish sister city or sister province relationships with the state of ֱƵ, or ֱƵ municipalities, and that have been approved by the president; a list of participating and approved communities shall be published in university regulation; I. Students designated by the UA Scholars Program participating in theas UA Scholars Program; J. Participants of the University of ֱƵ College Savings Program Plan who meet eligibility criteria as may be established by the ֱƵ TrustEducation Trust of ֱƵ. K. Spouse or dependent children of a University of ֱƵ employee; or L. Students that graduated within the past twelve months from a qualified ֱƵ high school.
